For any business, Chinese or foreign, the Employment Contract Law will not bring much of a financial burden, as long as they were in compliance with the old labor laws before the new law took effect on January 1, 2008.
"The people who say laws will cost a lot of money to implement are those who are not complying with the existing laws prior to January 1, 2008," said Mark Wells, a foreign lawyer from the Beijing-based Zhenbang Law Firm.
As far as he knows, responses from foreign businesses have ranged from "no major drama" --- just a matter of rewriting employment contracts --- to there is "so much money to pay that some workers have to be fired."
In his opinion, the law is not really a "radical or more expensive movement," but will be for companies which are not in compliance with existing laws. He said his perspective is widely shared by lawyers.
Wells claims that the radical responses mostly come from employers who are not complying with the old laws. He adds that most foreign companies are doing the right thing, but there are always some "bad apples."
