On December 2, Beijing solicited opinions from its Legislative Affairs Office "on Beijing's implementation of the Law of the People's Republic of China on the Protection of Rights and Interests of Women". The draft again places great importance on sexual harassment issues. It clearly stipulates that organizations such as employment units, educational institutions and management bodies of public places should take effective measures to prevent and stop sexual harassment. If and when the Council of Women Workers receives a complaint, it should carry out investigations, register and keep files of the case or provide recommendations to the relevant departments on how to handle it. The Work Committee for Women and Children should urge relevant units to handle sexual harassment incidents in a timely manner and penalize those who are liable for the harassment.
Female workers or the Committee of Female Workers have the right to ask work units to add preventative sexual harassment clauses into the labor contract or collective contract. Work units that do not establish measures to prevent and stop sexual harassment will be punished as responsible for damages.
The draft also defines the pattern of sexual harassment, and creates mechanisms to file complaints and impose punishments. The sexual harassment complaints would be filed with the police or the court. The responsible companies will be punished. Additionally, when lawful inspection and body-searching of a woman is carried out, it must be conducted by female law-enforcement personnel and doctor.
