From a foreign legal practitioner's perspective, China's judicial system is fine and has been improving day by day, in leaps and bounds, especially since the country's accession into the WTO. There is a lot of criticism and negativity around law enforcement in China. Mark Wells, a foreign lawyer in the Beijing-based Zhenbang Law Firm, said China has been responding well to the criticisms. "You can go to court, win, and have enforcement," he noted.
Mr. Wells does not think the criticism is fair. He thinks many people making the criticisms have never "been to court or followed a court case in China."
In his experience, he has noticed that his firm wins court cases when they should; and loses when they probably should lose. Another important thing is that you will not know the result of a court case until the case is finished. But in many other countries, you know the result even before the case is finished.
In his observation, the judicial systems in developed countries are not perfect. Nor is the one in China. But it is developing well in China. "People standing in glass houses shouldn't throw stones."
"Enforcement is available if you use the law to its full extent and follow the rules and procedures," said Mr. Wells.
