Acting speaker of the Palestinian Legislative Council (PLC) Ahmed Bahar Sunday said President Mahmoud Abbas has to designate a new prime minister as PLC failed to convene and thus failed to grant legitimacy to the Salam Fayyad 's caretaker government. Bahar told reporters that Abbas should designate a new premier as the constitutional term of Salam Fayyad's caretaker government expired today with the failure of the PLC to convene. He made the remarks after the PLC failed to convene on Sunday, the third time in three weeks due to the constitutional disputes between rival Hamas and Fatah movements on the legitimacy of the sessions.
As the required quorum wasn't meet owing to Fatah lawmakers' boycott, the caretaker government lost the chance to get a vote of confidence. Fayyad's second government can only be legal if it gains the PLC confidence. Last week, Fayyad addressed a letter to Bahar urging him to hold a PLC session to vote over offering confidence to his caretaker government. Bahar invited the PLC members to attend Sunday's session.
However, Secretary General of the Hamas-dominated parliament Ibrahim Khreisha (Fatah affiliated) told reporters that "it became legally and physically impossible to hold a session for the parliament." "Bahar's call for holding irregular parliamentary session today is lacking a constitutional and legal capacity," Khreisha said.
Officially, the PLC is made up of 132 lawmakers. After one from Fatah died a few months ago, the number rested on 131. Forty-three lawmakers out of them are held in Israeli jails since July last year.
