The European Union Commission requested on Thursday that member-state Italy amend its legislation on pharmacy locations.
Under Italian law, pharmacists are not allowed to have more than one pharmacy. The maximum number of pharmacies that may be owned by groups of pharmacists should not exceed four and must be in the same province.
"Such constraints are in breach of Article 43 of the EC Treaty on freedom of establishment," the EU Commission said in a statement.
The request is in the form of a "reasoned opinion." "If no satisfactory reply is received within two months, the Commission may refer the matter to the Court of Justice," the statement added.
