An attorney for Britney Spears filed an ex-parte motion on Wednesday for a hearing requesting the court expand her visitation rights to include overnight privileges with her sons, Sean Preston and Jayden James, according to Access Hollywood.

The hearing was granted and scheduled for 8:30 a.m. Thursday in a downtown Los Angeles courtroom. Under the court's current ruling, Spears is only allowed monitored visitation during the day with the boys.

Spears’attorney, Sorrell Trope, is currently out of the country, but attorney Lori Howe from Trope's law firm will be handling the case during his absence.

Earlier this week, Trope told People the pop star had been passing her court-ordered drug tests, which will likely help Britney's argument.

"She's passed her random drug tests," Trope told People. "There's been more than one. They came up negative."

Trope also told People the pop star has a "good" shot at regaining split custody of her two kids "based on the overall circumstances of the case."
